Terms of Service
These terms are an agreement between Samorastnik d.o.o., Ozare 19, 2380 Slovenj Gradec, Slovenia (“Wavelens”, “we”, “us”) and the organization that signs up for or uses Wavelens (“Customer”, “you”). The person accepting them confirms they may bind that organization. If you have signed a separate written agreement with us, it takes precedence over these terms.
1. The service
Wavelens is a hosted service that connects to the tools you choose (such as email, chat, support, billing and product analytics), keeps a record of what is known about your customers, and checks what AI agents tell your customers against that record. We may improve and change the service. If we remove a feature you rely on, we will tell you in advance.
Some features are labelled beta or early access. They are provided as they are and may change or end.
2. Accounts
You are responsible for the people you invite to your workspace, for keeping sign-in details and API keys secret, and for everything done under your account. Tell us promptly at [email protected] if you suspect unauthorized access.
3. Your data
- You own the data you bring into Wavelens and the results derived from it (“Customer Data”). You give us the rights we need to host, process and display it to provide the service to you.
- You are responsible for having the right to connect each source and to process the personal data in it, including telling the people concerned and having a legal basis.
- We process personal data in Customer Data as your processor, under our Privacy Policy and a data processing agreement, which we provide on request and which forms part of these terms.
- We do not sell Customer Data, and we do not use it to train AI models that serve anyone but you.
- While your subscription is active you can ask us for an export of your data. After it ends, we delete Customer Data as described in the Privacy Policy.
4. Connected services
When you connect a third-party service (for example Google, Microsoft, Slack, Intercom or Stripe), your use of it stays subject to that provider’s terms, and you authorize us to access it on your behalf for the purposes you set up. Data received from Google APIs is handled as described in the Google section of our Privacy Policy. We are not responsible for third-party services, their availability, or changes to their APIs.
5. AI output
Wavelens uses AI models to extract facts, check claims and draft text. AI output can be wrong or incomplete. A finding that an answer was right or wrong reflects the record available to Wavelens at the time. Review findings and drafts before acting on them or sending them; you remain responsible for what you and your agents tell your customers.
6. Acceptable use
You may not use Wavelens to break the law or anyone’s rights; to send spam or unsolicited bulk messages; to process data you have no right to; to try to reach other customers’ data, probe or overload the service, or get around its limits or security; or to build a competing product by copying it. We may suspend access that puts the service, other customers or third parties at risk, and will tell you why.
7. Fees
Paid plans are billed in advance at the prices shown when you subscribe or in your order. Unless stated otherwise, fees are non-refundable and exclude taxes, which you pay. We may change prices for a coming renewal period with at least 30 days’ notice. If you do not pay on time, we may suspend paid features after giving notice.
8. Our property
We own Wavelens, its software and its documentation. You receive a non-exclusive, non-transferable right to use the service during your subscription. If you send us feedback, we may use it without obligation to you.
9. Confidentiality
Each of us will protect the other’s non-public information with reasonable care, use it only for this agreement, and share it only with people who need it and are bound to keep it confidential, or when the law requires it.
10. Warranties
We will provide the service with reasonable skill and care. Apart from that, and to the extent the law allows, the service is provided “as is”, without other warranties, including that it will be uninterrupted or error-free.
11. Limitation of liability
To the extent the law allows, neither party is liable for indirect or consequential loss, or for lost profits, revenue or data, and each party’s total liability under these terms is limited to the fees you paid us in the 12 months before the event that gave rise to the claim (or EUR 100 if you use a free plan). These limits do not apply to liability that cannot be limited by law, including for intent or gross negligence, or to your payment obligations.
12. Term and termination
These terms apply while you use the service. You can stop using it and delete your workspace at any time. Either party may end the agreement if the other materially breaches it and does not fix the breach within 30 days of notice. Sections 3, 8, 9, 11 and 14 survive termination.
13. Changes to these terms
We may update these terms. We will post the new version here and, for material changes, tell account holders at least 30 days before they take effect. Continuing to use the service after that means you accept them.
14. Governing law
These terms are governed by the laws of the Republic of Slovenia, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The courts of Ljubljana have exclusive jurisdiction.
